Disqualifications

1 Nuclear Power

In terms of the Marrakech accords nuclear power facilities are effectively disqualified from earning CER's under the CDM. This can be seen as an exception to the principle that host countries can determine the content of sustainable development in that country.

2 Peremptory municipal legislation

Initially the position was that if the project is directly or indirectly mandated by legislation in the host country, it would not be eligible for CDM. This was changed by Executive Board 16 annex 3, which creates a complex but highly sophisticated set of rules for dealing with the matter and which largely removes the previous perverse incentive punishing countries with progressive policies on renewable energy.

3 Official Development Aid (ODA)

If a project is financed by pre-existing official development aid, it is not eligible for CDM. This has potentially far-reaching results as some of the annex 1 countries are both large providers of ODA and large potential buyers of CER’s.
